Precision Castparts Settlement
A multimillion-dollar settlement has been reached in the litigation captioned: Resendez, et al. v. Precision Castparts Corp. and PCC Structurals, Inc. filed as case No. 16CV16164 before Judge Thomas M. Ryan of the Multnomah County Circuit Court of Oregon. The lawsuit alleges that certain metals, including nickel, emitted from defendants' production interfered with the use and enjoyment of Portland property or were emitted and/or deposited on these properties, causing both physical damage and “stigma” damage to these properties.
The Court did not decide whether the defendants or the plaintiffs are correct. Instead, both sides have entered into this Class Action Settlement to resolve plaintiffs’ claims.
What Does the Settlement Provide?
The Settlement provides that the defendants will: 1) install $1.95 million worth of enhanced pollution controls at its facilities; 2), spend an additional $7.7 million on emission control equipment; and, 3) pay $12.5 million into a Settlement Fund for cash payments to Class Members. Potential Class Members must file a claim to receive a refund from this latter portion of the Settlement.
